JULY 2007

Butler Palmer Barrett Rouhe Urbanoski

Motion  2007-7-special

(Committee)

This motion voided the May 15th, 2007 motion that transferred the existing lease for Johnson's Landing from Neil Johnson to West Shores Marina & RV Park, LLC.

EDITORS NOTE:

The May 15th, 2007 lease transfer contract was disputed by Director Barrett at the May 15th meeting as for the fact that under Government Code 1090 a board cannot vote on any contract where any director is a party to the contract whether or not that director refrains from participating and voting on the contract.  Director Rouhe was a principle partner of West Shores Marina & RV Park, LLC at the time of the transfer vote.

The  districts legal counsel agreed at the July 30th, 2007 special meeting that Director Rouhe had violated Gov. Code 1090 and that the lease transfer was unenforceable.
